There seems to be a discrepancy over who won the battle between ACP and UMA. The picture in question is the one below that Batista took. The question is who had the lead at this point. UMA argues that they had more soldiers. Jedi’s argument is that some of these soldiers are not UMA soldiers but are other penguins wearing red who were present prior to the battle.

Here are my arguments:
- This picture was taken prior to the battle. Though it was only one minute before, many of the random penguins that had turned red while UMA was waiting for the beginning of the battle left after we charged and joke bombed UMA for the first 2-3 minutes.
- The rules state that you gain a point for having more soldiers than the opponent for 5 minutes straight. Just because UMA had more soldiers at this one single moment should not affect the scoring at all. Even if they did hold the majority at this point, which I do not believe is true, they should not be awarded points for this single instance.
- Some of the soldiers marked by Batista were not UMA soldiers. The ones circled in blue were penguins that I could read the names of clearly enough to check the UMA ranks and say that they were in fact, not ranked members of UMA. The other blue ones were clearly not in UMA uniform (one at the top was even the color green), wearing items such as a crown and pink sweatshirt/scarf. The ones circled in green were not necessarily UMA soldiers, but I could not tell whether they were or not, so I have including since I cannot be sure.
My final count is that there are at most, 21 UMA (with 4 in question), whereas there are at most 26 ACP soldiers (maybe as few as 23). Regardless of the total number of ACP soldiers, there are not enough actual UMA soldiers for there to be a majority, and even if UMA and ACP were even, no points should be awarded because neither held the significant majority. It is my belief that after this point, UMA lost soldiers throughout the battle while ACP gained soldiers, resulting in the recorded majority that ACP had at the conclusion of the battle. I hope that this sheds some light on the subject so that we can make a proper decision.
